Terms of service

1. Who we are
Shopmorphic is run by Lightmorphic in the United Kingdom. "We" and "us" mean Lightmorphic. "You" means the person or business that opens a shop on Shopmorphic.
2. What Shopmorphic is
Shopmorphic is software for running an online shop: a storefront, a dashboard, checkout, content, emails and analytics. We host it and keep it running. That is the whole service.
3. Your shop is yours
Every sale on your shop is a contract between you and your customer. We are not a party to it. We do not sell, deliver, refund or arbitrate. If a customer has a problem with an order, it is between you, the customer and your payment provider. You are responsible for what you sell, for describing it honestly, for delivering it, and for following the consumer law that applies to you.
4. Payments
Customers pay you through your own Stripe or PayPal account. Shopmorphic never holds your money, never takes a cut of a sale, and never sees card details. Refunds, chargebacks and disputes happen in your payment provider's account under their terms.
5. Our fees
You choose one of two plans on the pricing page: a flat monthly fee, or a fee per paid order with no monthly charge. Per-sale fees are added up on a monthly statement. Fees are billed to a card you keep on file with us, through Stripe, and are shown without VAT; VAT is added where it applies. You can change plan or close your shop at any time from your dashboard. We may change our prices with a month's notice by email.
6. Your account
Keep your password to yourself and turn on two-factor sign-in. You are responsible for what is done with your login and with the logins you give your team. Tell us straight away if you think somebody else has got in.
7. Your customers' details
You are the controller of the personal details your customers give your shop. We process them on your behalf, only to run your shop, and only as this page and our privacy policy describe. We keep them in the United Kingdom, encrypt secrets and chat messages at rest, and give you the tools to answer your customers' requests to see or remove their details. If you need a separate data processing agreement, ask us.
8. What you may not do
Do not use Shopmorphic to sell anything illegal, counterfeit, or that your payment provider forbids. Do not send email to people who have not asked for it. Do not try to reach other sellers' data or to interfere with the service. We can suspend a shop that breaks these rules; we will tell you why and give you a chance to put it right unless the law or the safety of others stops us.
9. Keeping the service up
We do our best to keep Shopmorphic running and we back up every night, but we do not promise it will never be down. We are not liable for lost sales or profits while it is. Our liability to you for anything to do with the service is limited to the fees you paid us in the twelve months before the problem. Nothing here limits liability that the law says cannot be limited.
10. Leaving
You can export your whole shop from Settings and close it whenever you like. Fees already due stay due. Thirty days after a shop closes we delete its data, except what tax rules make us keep.
11. Changes and law
If we change these terms in a way that matters, we email you a month before. These terms are governed by the law of England and Wales, and its courts decide any dispute about them.
